GS Medical Group (“GS Medical Group”, “we”, “our” or “us”) is committed to ensuring that all members and supervisors who engage through GS Medical Group adhere to the principles set out in the Civil Procedure Rules in the UK: https://www.justice.gov.uk/courts/procedure-rules/civil (“CPRs”).
Please follow the principles outlined in this Policy, so that the CPRs are complied with at all times.
Practitioners who wish to perform the function of an Expert Witness, will need to ensure that they strictly follow the CPRs. This includes the Practice Direction accompanying Part 35 of the CPRs and the Guidance for the Instruction of Experts in Civil Claims 2014, as amended.
As part of compliance with the CPRs, it is expected that Members of the GS Medical Group will do the following:
1. Uphold the general overriding duty to the Court to help it with matters that falls within the expertise of the Member;
2. Produce reports which comply with the CPR Practice Direction;
3. Produce evidence as part of their Expert Witness role independently and uninfluenced by litigation;
4. Provide their opinions in an objective, unbiased manner and within the remit of the Member’s expertise;
5. Where an area falls outside the Member’s area of expertise, disclose this fact to the Court;
6. Declare that the Member understands and has complied with their duty to the Court and the CPRs, including their role as an Expert Witness, report writing and courtroom skills;
7. Keep themselves up-to-date and trained in their area of expertise and in relation to implementation and running of the Court procedures, Practice Direction and CPRs, together with reading judgments, articles, sample reports and other materials, as required.
We may update this Policy from time to time and we will provide you with notice of any such updates, when these become available.
